TERMS AND CONDITIONS – SWING LITERACY DEVELOPMENT METHOD & CANADIAN SWING CHAMPIONS

Please read these Terms and Conditions (“Terms”) carefully before using the Swing Literacy Development Method (SLDM) or Canadian Swing Champions website (CSC), collectively referred to as the “Services”, operated by Myles Munroe and Tessa Cunningham-Munroe (M&T).

Your access to and use of the SLDM or CSC is conditional on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms.

Accounts

If you create an account with us, you must provide information that is accurate, complete, and current at all times. If you fail to do so, you will be in breach of these Terms. M&T reserve the right to terminate your account at any time and without notice in the event of a breach of these Terms.

You are responsible for safeguarding any passwords you use to access the Services. You agree to not disclose your password to any third party. If there is any real or possible breach of security or unauthorized use of your account, you must notify us immediately.

You are responsible for any activities or actions that occur using your password or account.

You must not, at any time, create an account for the purpose of abusing the functionality of the website or other users. You must not, at any time, seek to pass yourself off as another user.

You will not do anything to assist someone who is not a registered user to gain access to registered areas of the Services.

Purchases

If you wish to purchase any product or service made available through the SLDM or CSC (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your name, payment information, address, and contact information.

All payments are made through either Stripe or PayPal for security reasons. You must follow the terms and conditions set by Stripe or PayPal for payment.

M&T will activate any online purchases within seven (7) days of receipt of payment, and ship any tangible products within seven (7) days of purchase. For any services purchased, the services shall be rendered on the time and date agreed to prior to the purchase.

Rights to Intellectual Property

All copyright, trademarks, design rights, patents and other intellectual property rights (registered and unregistered) in, on or related to the Services belongs exclusively to M&T and/or to the third party that retains the right to the material. Nothing in these terms grants you any right or license to use any intellectual property belonged or controlled by M&T or any other third party, unless otherwise expressly provided for in writing.

Returns and Refunds

You are not entitled to any refund for any digital products, services, or tangible products purchased in relation to the Services, unless otherwise expressly stated. M&T may decide, in their sole discretion, to offer refunds, exchanges, or rebates on a case-by-case basis.

Links to Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by M&T.

M&T have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that M&T shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

Prohibited Activities

At no time during your use of the Services will you be permitted to use the Services for any unlawful or prohibited purpose. This includes but is not limited to:

• harassing, abusing or threatening any person
• engaging in plagiarism
• creating multiple or false accounts
• posting copyrighted content that does not belong to you

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

If you continue to access or use the Services after changes are made to the Terms, you are deemed to have agreed to be bound by the revised terms.

Termination

M&T reserve the right to terminate or suspend access to any of the Services immediately, without prior notice and without liability, for any reason whatsoever, including without limitation a break of these Terms.

Upon termination, your rights to use any of the Services will immediately end.

If you wish to terminate your account, you may send an email or message through the CSC website.

Disclaimer of Warranties and Limitation of Liability

M&T DO NOT GUARANTEE, REPRESENT, OR WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, AND YOU AGREE THAT FROM TIME TO TIME, M&T MAY REMOVE THE SERVICES OF RINDEFINITE PERIODS OF TIME, OR CANCEL THE SERVICE AT ANY TIME, WITHOUT NOTICE TO YOU.

YOU EXPRESSLY AGREE THAT YOUR USE OF, OR INABILITY TO USE, THE SERVICES IS AT YOUR SOLE RISK. THE SERVICES AND ALL PRODUCTS DELIVERED TO YOU THROUGH THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” FOR YOUR USE, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NONINFRINGEMENT.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES. IF YOU RESIDE IN ONE OF THOSE JURISDICTIONS, THE ABOVE EXCLUSION OF IMPLIED WARRANTIES MAY NOT APPLY TO YOU.

To the extent permitted by law, M&T will not be liable for any loss caused as a result of your doing, or not doing, anything as a result of viewing, reading, or listening to any content provided by the Services, or linked to by the Services.

M&T do not give warranties of any kind about the content provided through the services.

Indemnification

You agree to defend, indemnify, and hold harmless M&T, and any of its affiliates, officers, or employees from any and all claims, liabilities, costs, and expenses, including but not limited to lawyer fees and expenses, arising out of a breach by you or any user of your account of these Terms or privacy policy arising out of a breach of your obligations, representation or warranties under these Terms.

Governing Law

These Terms shall be governed and construed in accordance with the laws of British Columbia, Canada.

No Waiver

The failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these terms will remain in effect.

Entire Agreement

These Terms constitute the entire agreement for use of the Services.
